Mr. Justice Darling, at the Chester Assises (Court), speaking of death sentences passed on persons convicted of performing illegal operations for abortion, said that every one who did not live in the clouds knew that such sentences could not be carried out.

It was putting judges and juries in an undignified and absurd position to cause them to decree the highest penalty of the law in such cases, with full knowledge that the proceedings were a sham.

He advised the Grand Jury if they found a prisoner did not intend to kill a woman not to return a true bill for murder but to find a true bill on the charge of procuring abortion.

He would submit both bills to them.
